Mr Chernyavsky combines his professional expertise in cross-border finance and capital markets with a unique understanding of the transactional aspects of intellectual property law. He helped to create tax-efficient IP holding structures in Ukraine and handled complex projects providing for the transfer of IP rights and setting up IP-related businesses. In particular, he is considered one of the top lawyers in the IT sector in Ukraine, advising investors and start-ups on various issues of their operations.
Policy shaping and legislation drafting
Nazar has been advising the EBRD on the new legislation in the financial and energy efficiency sectors. More specifically:
on Local Capital Market Development Project: undertaking expert analysis of the Ukrainian legislative framework regulating debt capital markets, including legislative framework for derivative instruments; working out long-term recommendations to improve Ukraine’s debt capital markets; producing legal report containing general overview of the legislative framework in the area of debt capital markets, the analysis findings, and recommendations;
on Derivatives Reform: assisting in the developing of the Draft Law on Derivatives which addresses the problematic issues of the validity and enforceability of derivatives transactions in Ukraine;
on UAH Bond Issue Project related to performing the analysis of local capital markets regulations;
on ESCO concept related to developing favourable legislative framework to enable the implementation of ESCO projects in Ukraine.
